What the Police Can Do

  1. They can arrest and charge the person if an assault takes place 

    AND/OR

  2. Apply for an Apprehended Domestic Violence Order (ADVO). The police can do this by phone even outside of normal business hours.

  3. They can remove/confiscate firearms/dangerous weapons from the offender’s possession.

Apprehended Domestic Violence Orders

An Apprehended Domestic Violence Order (ADVO) is a court order that can protect a person from violence or threats of violence. ADVOs are mostly used in domestic violence cases. 

There are two ways to apply for an order:

  • A police officer can make a complaint on a person’s behalf, or

  • A complaint can be made directly to a Chamber Registrar.

Domestic Violence Court Advocacy

Western Sydney Women’s Domestic Violence Court Advocacy Service can help women experiencing domestic violence to gain access to legal advice, support, information and a safe room to sit in. This service is free and staff attend Penrith Local Court every Tuesday to assist women with ADVO matters.

Why a Court Advocacy Service?

  • To assist women seeking an Apprehended Domestic Violence Order to gain legal representation.

  • To familiarise women with the court process, layout and personnel.

  • To look at the full facts of the complaint and related matters so that conditions appropriate to a woman’s particular circumstances are sought.

  • To make referrals on all necessary social needs including income security, housing, counselling and support.

  • To assist with as far as possible, safety whilst in the precinct of the court.

  • A referral contact point for the Nepean Police Area Command, where safety assessment and support options are discussed with women following a domestic violence incident.


Staying Home Leaving Violence

Staying Home Leaving Violence is a service that can assist women and children, who have experienced domestic violence to remain safely in their homes without the violent person.

A support worker from Staying Home Leaving Violence can:

  • Talk with a woman and help her decide whether she and her children want to stay in the family home.

  • Work with a woman to develop a safety plan.

  • Provide women with information about Apprehended Domestic Violence Orders and give them support at Court.

  • Help women feel safer at home by providing security upgrades where necessary. This may include a personal alarm or providing new locks.


DV West

DV West is a not-for-profit organisation that provides services to women and children whose lives have been impacted by domestic and family violence and related issues including homelessness.


The Haven

The Haven provides crisis accommodation for women and children in the Nepean Region who are escaping domestic violence.

Referrals are to be made by services.
